1.- USE OF THE CAR
The person renting the car is in agreement with the fact that has been given a car in good mechanical order supplied with the neccessary papers, with thetyres in good condition and provided with the accesories.he undertakes to keep said car in the same good shape, and to drive it in accordancewith the motoring regulations of this country, and he also will abide whth the following rules:

• a) Not to let any other persons drive thecar, apart from, those who have been expressly authorised to do so by means of this contract.
• b) Not let the car be driven if the driver is in inferior physical condition, such as may be caused by alcohol, drugs, tiredness or illness, etc.
• c)Not to interfere with the mechanics of this car such as seals, etc., and BENYACAR S.L. should be informed about any damages or other problems that may occur with the car.
• d) Not to cary more passengers thanwhat is allowed by law and in accordance with the papers from the manufacturer.
• e)To keep the car well parked when not in use. In the case of travelling far away from where it was rented, he is under the obligation to keep it protected from extreme weather cahnges, such as ice and snow, atc.
  Cars BENYACAR S.L. it ( he, she) neither will provide of vehicle of substitution in case of substraction or theft, nor will return any amount.
• f) To return the car in time and the contract, any changes in this regard must be approved of my BENYACAR S.L., in the case of this rule not being respected, has the right to take back the car, or to request the return of same judicially, and to suspend the applying of the rate originally establishedin the contract.

LIMITATIONS AS TO USE:
Use only for social, domestic and pleasure purposes. The policy does not cover use fr subrenting or reward, the carrieage of goods peacemaking, reliability trial speed testing, car racing or use for any purpose in connection with the motor trade.

2.-PRICE FOR THE RENTAL
The person who rents a car agrees to pay, notorily the rate for the renting of the car and the corresponding taxes, but also the possible loss of the car papers ( estimated at 50 euros) spare tyre and other car accesories, plus any fines and legal costs incurred when using the car, also the violations of the traffic regulations and laws, by the person renting the car or by other persons who are autorized to drive the car.
Certain approved credit cars will be accepted for the car hire. In all cases the amount estimated by the rental company must be paid in advance.
Travel agency documents will be accepted, under the condition that these are autorised and filled out by said agencies.

3.-INSURANCE
The insurance suppliied by BENYACAR S.L. insures the person who rents the car and the persons autorised to drive it, as per this contract, with regard to civil responsibility ( damge to third persons ) for an unlimited amount of money.
With regard to this insurance, the following parties wil not be considered third persons spouse, ancestors,descendants, sister and brother or other family members of the person who rents the car, nor the person/s authorised to drive the car, or other persons who may be dependet upon him, with a salary, or in any other way.
The insurance does not cover the loss, thefl, or damages caused to belongings and objects transported in the rented car.the responsability of the person renting the car with regard to damages of said car is totally covered in the case of theft or fire, and it is limited to the figure established as franchise in the present rates for accidents. By paying the insurance fee, (CDW) see separate list for cost, the person who rents the car may be freed of this liability, in which case he definitely must sign his name in the contract.

4.- ACCIDENTS
The person renting the car is under the obligation to inform the BENYACAR S.L. immediately when any kind of accident happens, and also to send them any letters, or other documents relating to this accident, and in any way collaborate with BENYACAR S.L. and the insurance company with the investigation and defence of any claims or legal costs. The person renting the car undertakes to do the following.
To write down all the necessary informations concernig the other party, name and address of driver and insurance company. Car registration number, ( if foreign, number of green card ), wich he, together wich all the details of the accident, time, place, how it came about, etc and width of road and wether conditions, name and address of witnesses must be send to BENYACAR S.L. with all possible urgency, and in the case of a serios accident, this information should be given over the telephone. Never admit to the resposability of the accident.
Not to accept nor to have a preconceived idea about the responsibility of waht has happened.
Insist on calling the police in case the fault may rest with the other party. Donot move vehicles beforepolice arrive.

5.-REPAIRS AND MAINTENACE
The repairs of a breakdown that has occured because of our servicing ( thereby excluding those due to negligence, inability, and/or lack of skill by the driver, such as chagin of oil and lubrication), the costs incurred will be refunded by BENYACAR S.L. once this has been autorised, and thereafter justified by means of an invoice, under the condition that fir, does not exceed euros 30,05.
The responsability en behalf of BENYACAR S.L. consists in them having taken all the neccesary stepsin order that mechanical defects may be avoided in the car tented, but in the event that they did happen, they do not take responsability for the problems that this may cause, directly, to the person renting the car.

6.-THE CONTRACT
In the event the person renting the car has done so in the name of a company or other person, the responsibility will be for all interested parties.
Autos BENYACAR S.L. will make photocopies of the documentation ( D.N.I. passport, driving licence, cards of credito/debito, etc) that considers opportun, with the objective to maintain a level of security adpted in the delivery of its vehicles.

7.- JURISDICTION
The client, disregarding bis/her nationality, declares having read all the conditions of this contract, and with a view to all the defems problems that may be caused by the application of the above regulations, he will abide with the spanish law and with the cours of Malaga.
The company or his( her, your) representative saves himself ( herself) the right this contract for breach of any in force norm of the code of in force traffic or for considering that the driver or lessee could commit an outrage against the interests of the same one, persons looked by the law or with pena preccedents. The company will not return any amount not partially or whole of the rent.

IMPORTANT
All puntures or damages to tyres or rims will be completely hirer´s responsibility.
In case of damages or breakage of the car driving off normal, asph alted roads will be on hire´s charge (tow service and so on)
